Insurance related Disputes

  • a global general insurance company in Asia on the liability of a shipowner and shipyard for the capsizing of a ship during a repair including coverage of a Ship repairer’s Liability Insurance.

  • a Thai insurance company in respect to a subrogated claim under a fire insurance policy arising from a fire at the insured warehouse. This involved investigation into the cause of fire and identifying to the landlord and/or tenant of the origin of the fire who must be liable for the loss.

  • a Thai insurance company in respect to a subrogated claim under an International Property Damage and Business Interruption Insurance arising from an explosion at a factory. This case involved the Hazardous Substance Act and an interpretation of an exclusion under the insurance policy on contamination to the property insured and meaning of the explosion.

  • a major Thai insurance company in respect to a subrogated claim under a Marine Cargo Insurance due to the capsizing of a ship causing damage to a cargo of timber and represented the insurance company in the Central Intellectual Property and International Trade Court.

  • a major Thai insurance company on the coverage for the salvage fee under a Hull and Machinery Insurance due to the capsizing of a ship.  The advice involved whether the Hull and Machinery Insurance covered the salvage fee (which is opposed to a clear wording on salvage charge) and a cut-off date for the claim and labour expenses in a case of constructive total loss.

  • a major Thai insurance company on coverage of Marine Cargo Insurance and a potential subrogated claim under it against a carrier due to contamination to liquid cargo on board a ship.  The advice involved an arrest of the ship, proper wording of a letter of undertaking, and a subrogated claim under the Carriage of Goods by Sea Act.

  • a major Thai insurance company with a legal opinion on the coverage of (1) Carrier’s Liability and (2) Protection and Indemnity Insurance for the capsizing of a vessel and successfully negotiated with the insured in this respect to refrain from litigation.

  • an offshore reinsurance company, on an arbitration claim filed against it at the Thai Arbitration Institution. This related to claims under four reinsurance treaties. Advising our client on setting aside the above domestic arbitral award.

Medical Malpractice and Other Injury-Related Insurance

  • a leading pharmaceutical company, in relation to the managing director who was found committing misconduct which was against the code of ethics of the client and pharmaceutical industry. This matter involved the code of ethics of the client and pharmaceutical industry in supporting and subsidizing doctors to participate in international conferences on medical issues.
  • an insurer, whose insured is a prominent hospital group, on a medical malpractice claim arising from negligence of a doctor during surgery (surgical instrument accidentally hit the patient’s vertebral arteries).
  • an insurer, whose insured is a prominent hospital group, on a medical malpractice claim arising from insufficient monitoring by doctor and nurse during treatment for stroke.
  • an insurer and insured, a prominent hotel chain, on a death claim (a traveler had drowned in the swimming pool of the hotel and died later at hospital).
  • an insurer for an injury claim which involved multinational parties and laws (a foreign traveler fell down from an unsecured hotel balcony).  

Employment

  • a leading group company in plastic moulding, in a court dispute where the company was sued by its ex-management for unfair dismissal and severance pay. The court of first instance ruled in favour of the client by totally dismissing the plaintiff’s claim.
