Wanchana is a Senior Associate at Chandler MHM in the Litigation practice group. Prior to joining Chandler MHM Wanchana worked for another leading law firm in Thailand. He has also worked as a senior legal manager for a well-known corporate in Thailand. Wanchana has more than 10 years experience advising on a broad range of civil and criminal matters. His experience also includes advising on business rehabilitation.

RELEVANT CLIENT EXPERIENCE

Some Representative Transactions:

• a client in its appeal against an assessment of value added tax. This case involves legal interpretations as to whether the aggregate fees charged under the THPD-GPO agreement for inland transportation as well as ancillary services are vatable. The main issue of the case is whether the VAT assessment is inconsistent with the Revenue Code which provides that revenue from inland transportation is VAT exempted.
• the Thai subsidiary of a major UK life insurance provider in relation to serious criminal allegations made against it and its directors. The case involves an alleged fabrication of a loan agreement under a life insurance policy.
• a global aviation lessor, a subsidiary of a leading Japanese institution, in relation to the debt restructuring and business rehabilitation process of its Thai debtor, a major Thai full-service airline business listed under the Thai Stock Exchange.
• a leading metal manufacturer in a business rehabilitation case. Our representation included providing legal advice, preparing and submitting a petition for an absolute receivership order and the debt repayment application, attending various meetings with the official receiver, and attending court hearings.
• an air-conditioner company in its business reorganization, which included preparing and submitting the debt repayment application, attending the creditors’ meeting, and assisting with a variety of court hearings.
• an e-commerce platform in defending against claims brought by the Consumer Protection Board.
• a global logistics company and its insurer in multiple disputes arising out of a ship collision that caused damage to sensitive cargo.
• a banking institution in defending against a contractual claim.
• a property company in a dispute with a developer.
• outside counsel for the largest U.S. social network platform in providing legal advice and analysis on various issues (e.g., TDRs, Lese Majeste Content and Election-Related Content in Thailand, OTT Broadcasting, a service provider’s and ISP’s obligations and liabilities under the Computer Crimes Act.)
