Some Representative Transactions:

Aviation

  • a major leasing company in relation to the repossession of an A320-214 aircraft which a firm that rents and leases air passenger transport equipment, as lessor, leased to the lessee. This is the first repossession under the new regulation of the Civil Aviation Authority of Thailand that was implemented to be in accordance with IATA to enhance the aviation operation in Thailand.

Dispute Resolution / Litigation, Regulatory

  • a multinational car manufacturer on an approximately THB40 Million civil claim in relation to the termination of a dealership agreement and unfair trade conduct in respect of trade completion laws brought by its former authorized dealer.
  • a European-owned hotel distribution company on a debt recovery claim against its former business partner in Thailand. The dispute is complicated as it involved cross-border cooperation with foreign law enforcement agencies and internal police organizations, and had an anti-money laundering element.
  • an international precision machine components (PMC) manufacturer listed in the SGX Main Board in connection with a USD2.5 Million claim against its former authorized directors of its Thai subsidiary involving fraud of money transferred in and between Singapore, China and Thailand.

Insolvency / Restructuring

  • an Irish aviation lessor, in relation to the debt restructuring and business rehabilitation process of its Thai debtor, Thai AirAsia X Co., Ltd. (“TAAX”), a major Thai long-haul low-cost airline business. TAAX is a big player in the regional long-haul low-cost airline industry.
  • a global aircraft leasing firm listed under the New York Stock Exchange in relation to the debt restructuring and business rehabilitation process of its Thai debtor.
  • a Thai financial institution, in relation to the debt restructuring and business rehabilitation process of its Thai debtor.
  • a global aircraft financing services business, a subsidiary of one of the biggest commercial banks in China, in relation to the debt restructuring and business rehabilitation process of its Thai debtor.

Labor / Employment

  • a US-owned oil and gas engineering service provider which provided engineering services to support crude oil and natural gas exploration and drilling in relation to compensation claims from former employees (following a reduction of manpower). The compensation claim includes missing portions of severance pay, unfair dismissal damages and overtime payments under Thai labor law.

  • a US-owned natural gas processing and treating solutions provider which offered solutions in the oil, gas, water and power markets in relation to an internal legal audit and anti-corruption matter.

  • a global pharmaceutical synthesis and specialty ingredients manufacturer in relation to the workplace investigation matter on its Thai-subsidiary entity.

  • a producer and distributer of vehicle batteries and its subsidiaries in relation to the dismissal of employment and alleged breach of a share acquisition agreement brought against our client by its former major shareholders and founders of the group company.
