Chapter 5 - Security
This chapter outlines the types of security that are commonly granted in typical financing transactions, certain key features as well as how to perfect and enforce security interests in Thailand. Under Thai law, common forms of available security interests range from mortgages, pledges, guarantees under the Thai Civil and Commercial Code (the “CCC”), to security interests created under specific laws such as the Business Security Act, B.E. 2558 (2015), which come into force on 4 July 2016. There are other contractual arrangements between a security provider and a security receiver by way of assignment under the CCC.
